1. General, Scope, Terms
These Terms and Conditions apply to all site visitors, clients, customers, and all other users of the site. By using the Site or Service, you agree to theseTermsandConditions, without modification, and acknowledge reading them. Next Level Coach – Marius Bill, LL.M., CPC, ELI-MP (hereinafter referred to as Coach), conducts coaching and workshops and other events in accordance with these Terms and Conditions. Marius Bill & Associates – Legal Consulting German law (hereinafter referred to as Consultant) provides legal services in German law in accordance with these Terms and Conditions. With the commissioning of the coach or consultant these terms and conditions are accepted by the client (hereinafter referred to as customer). Deviating terms and conditions of the customer do not apply.
2. Offers, fees, terms of payment
The offers are non-binding and subject to change. For all offers, the fees published on the website and / or stated in the event invitation will be charged. Coaching fees for any type of coaching (e.g. in person coaching, group coaching or by phone, Skype or Zoom) are due at least 3 days before the respective meeting. The customer receives an invoice for the agreed period of coaching. Event registrations will be processed in order of arrival. The fees for workshops and any other events are due one week before the date of the event. The customer receives a registration confirmation and an invoice. Consulting fees for any type of consulting services are due one week after the consulting session.
3. Appointment and registration
Time and place of the coaching session are agreed by coach and customer in mutual agreement as well as any type of consulting services are agreed in same way by the consultant and customer. This can be done by e-mail or by phone. The time and place of the events are determined by the coach and accepted by the customer. Registration for events is exclusively in writing, by e-mail, via the contact form or via the respective booking form.
Agreed dates are binding. The customer undertakes to appear punctually on all agreed dates.
4. Cancellation of a coaching or consulting appointment or an event by the
customer
Cancellation or postponement of a coaching or consulting is possible no later
than 2 working days before the appointment and until then free of charge.
Thereafter, the fee for the agreed time will be charged at 50%. In the event of
cancellation or postponement on the day of coaching or consulting or in case of
no-show up, the full fee will be due as cancellation fee.
The cancellation of a booked event is possible up to four weeks before its begin. However, a handling fee of 200 Euro plus VAT will be charged. If canceled later or in case of no-show, the full fee for the event is payable.
5. Cancellation of a coaching or consulting appointment or an event by the
coach/ consultant
In the event that the coach or consultant has to cancel or postpone a coaching or
consulting appointment for urgent reasons, the customer will be contacted as
soon as possible to offer a replacement appointment. Further claims, in particular
claims for damages, do not exist.
In the event that the required number of participants in an event is not achieved or an event for other reasons must be canceled, the customer will be informed as soon as possible and will receive back the already paid participation fee. Further claims beyond that do not exist.
6. Copyright
Offers, tenders, coaching and consulting concepts, personally created CDs, MP3 files, e-books, online course documents and other documents are protected under copyright. All documents, videos, audios, PDFs, e-books, etc. given or made available to the customer are for personal use only. The customer is not permitted to reproduce the documents or parts thereof and / or make them available to third parties. A publication – also in part – is prohibited and can be prosecuted.
7. Liability
The Coach/Consultant undertakes to carry out all agreed services to the best of their knowledge. There is no guarantee for success in providing the service in coaching or consulting or at any events. Liability is excluded except the law determines any responsibility explicitly.
The customer confirms by appointing or registering for events or online courses to act on his own responsibility and to indemnify the provider from all liability claims. The customer accepts to be fully responsible for his physical and mental health and to pay for any damage caused by himself.
8. Confidentiality
The Coach/Consultant undertakes to maintain confidentiality on all professional, operational and private matters of the customer that have become known within the scope of the activity, even after the termination of the contract.
